BARÇA ONE TERMS OF USE

The Over The Top service, BARÇA ONE (hereinafter, "BARÇA ONE" or "OTT") is owned by BARÇA PRODUCCIONS S.L. (hereinafter, BARÇA STUDIOS), with registered office at Carrer Arístides Maillol, s/n, 08028 Barcelona, CIF B-16950321, registered in the Barcelona Trade Register, Volume 48024, Folio 154, Page B569855, 1st Entry B16950321.
This platform offers FC BARCELONA members, fans and supporters, as well as any other interested person, a personalised service (hereinafter, the "Service") that provides, recommends and helps you to discover within the FC BARCELONA environment: digital sports content, matches, digital series and documentaries, television programmes and other video content, both linear and on demand (together, the "Content"), as well as visual and audiovisual entertainment content that is available at any given time related to the Barça environment.
For any suggestion, query, complaint or claim, the user may contact BARÇA STUDIOS, through the current or future communication channels determined at any given time, such as:

BARÇA ONE is governed by the regulations exclusively applicable in Spain, with both nationals and foreigners who use this OTT service being subject to them.
Within the framework of the present conditions of use, the term "USER" is understood to include both those users who access BARÇA ONE without having a Barça Account, and therefore are not registered, and those who access the same through a Barça Account, and therefore are registered in this Barça environment.
Access to OTT BARÇA ONE by the USER is free of charge and its use is governed by the conditions of use in force at the time of access, which we ask you to read carefully. If the USER does not agree with the present conditions of use, he/she will have to abstain from using this portal and operating through it, being able to contact BARÇA STUDIOS to solve any doubt in relation to the same.
BARÇA ONE allows access to the non-registered user, the registered user or the subscriber, to the digital video platform owned by BARÇA STUDIOS.
Access to the platform can be done in the following ways:
(i) free content (the person accessing BARÇA ONE does not have to register to the Barça Account to have access to this content);
(ii) content with registration as a "REGISTERED USER". The user must register to access the content through the Barça Account, and;

(iii) content with subscription. The user, once registered, must subscribe and pay a monthly fee to have access to BARÇA ONE without advertisements, to priority content, to be able to download content for offline viewing, and will have to accept specific and additional terms and conditions.
The content offer will be made up of (descriptive and non-limiting) highlights and delayed matches of the football teams and other FC Barcelona sections, documentaries, content with players, interviews, behind-the-scenes, training sessions, live content, etc.

1. Intellectual Property.
All the contents, texts, images and source codes, although exploited by BARÇA STUDIOS, are the property of FC BARCELONA or of third parties from whom their exploitation rights have been acquired and are protected by Intellectual Property rights.
The USER is only entitled to make private, non-profit use of the same, and requires express authorisation to modify, reproduce, exploit, distribute or exercise any right belonging to the owner of the same.
BARÇA ONE, BARÇA STUDIOS and FC BARCELONA are a registered trademark and their reproduction, imitation, use or insertion of these trademarks is prohibited without due authorisation from FC BARCELONA and/or BARÇA STUDIOS.
The establishment of links on our website does not confer any right over the same. Likewise, the simple fact of establishing a link to a third party within the OTT BARÇA ONE does not give the right to be granted the category of collaborator or partner.
BARÇA STUDIOS and FC BARCELONA are exonerated from any liability for any claim regarding the intellectual property rights of the articles, contents and images published by third parties on its portal.
The total or partial imitation of our portal or the establishment of links to our OTT without the prior authorisation of BARÇA STUDIOS or FC BARCELONA is strictly forbidden.

2. Conditions of Access and Use.
Access to OTT BARÇA ONE is free of charge and does not require prior subscription or registration.
However, certain services are restricted to certain USERS and require a registration process, subscription and/or identification by means of passwords (being registered with a Barça Account). These services will be duly identified in the OTT.
The sending of personal data implies the express acceptance by the USER of our privacy policy.
Specifically, while using the OTT BARÇA ONE https://one.fcbarcelona.com/es, the USER agrees to:
- Access BARÇA ONE in accordance with good faith, the rules of public order and these General Conditions of Use. The access to BARÇA ONE is done under the own and exclusive responsibility of the USER, who will respond in any case of the damages and prejudices that can be caused to third parties or to us.
- Not to use or obtain the services, products and contents offered to BARÇA ONE, by procedures other than those stipulated in the present conditions of use and, if applicable, in the particular conditions that regulate the acquisition of certain products.
- Not to carry out any type of action on our portal that causes an excessive overload of operation to our computer systems, as well as the introduction of viruses, or the installation of robots, or software that alters the normal operation of BARÇA ONE, or in short may cause damage to our computer systems.
- Not to reproduce in any way, not even by means of a hyperlink, the OTT BARÇA ONE or any of its contents, without the express, written authorisation conferred by BARÇA STUDIOS and/or FC BARCELONA personnel with sufficient power for this purpose.
- Not to delete, evade or manipulate the copyright and other data identifying the rights of the owners incorporated into the contents, as well as the technical protection devices, or any of the information mechanisms that may contain the contents.
- Not to alter, reprogramme, modify, adapt or translate the source code of BARÇA ONE. Any partial or total reproduction of the source code of BARÇA ONE in any support and for any reason will be considered an unauthorised copy.
- Not to introduce, store or disseminate, on or from the OTT BARÇA ONE, any information or material that may be defamatory, offensive, obscene, threatening, xenophobic, inciting to violence, discrimination on grounds of race, sex, ideology, religion or that in any way violates morality, public order, fundamental rights, public freedoms, honour, privacy or the image of third parties and, in general, current legislation.
Not to introduce, store or disseminate, to or from the OTT BARÇA ONE, any programme, data, virus, code or any other electronic or physical device that may cause damage to the OTT, to any of the services, or to any of the equipment, systems or networks of FC BARCELONA or BARÇA STUDIOS, of any other user, of the sponsors, collaborators, suppliers, etc. of FC BARCELONA or, in general, of any third party.
- Not to carry out advertising or commercial exploitation activities through BARÇA ONE, and not to use the contents and information to send advertising, send messages for any other commercial purpose or to collect or store personal data of third parties.
- Not to use false identities or impersonate others in the use of the OTT or any of its services, including the use of passwords or access codes of third parties or in any other way.
- Not to destroy, alter, use for personal use, render useless or damage the data, information, programmes or electronic documents of FC BARCELONA or BARÇA STUDIOS, its sponsors, collaborators, suppliers or third parties.
- Not to introduce, store or disseminate through the OTT any content that infringes the intellectual or industrial property rights or business secrets of third parties and, in general, any content that it does not hold, in accordance with the law, the right to make available to third parties.
Taking into account the difficulty of controlling the information, contents and services contained in third party web pages available from our OTT, we inform you that BARÇA STUDIOS will not be held responsible, without prejudice to the fact that it will try, as far as possible, to ensure their legality.
BARÇA STUDIOS reserves the right to cancel the membership of any USER who has registered and/or subscribed to BARÇA ONE that the entity understands has violated the conditions governing the use of BARÇA ONE. Likewise, it reserves the right to take appropriate legal action against those who violate these general conditions of use.

3. Privacy Policy.
Confidentiality and security are fundamental values of FC BARCELONA and BARÇA STUDIOS and, consequently, we assume the commitment to guarantee the privacy of the USER at all times and not to collect unnecessary information.
The provision of personal data through our portal requires a minimum age of 14 years and the express acceptance of our Privacy Policy.
In any case, if you have any questions about the processing of personal data by FC BARCELONA, you can contact our Data Protection Officer, at the postal address indicated in the following section, for the attention of "Data Protection Officer", or by e-mail to the address dpo@fcbarcelona.cat.

4. Cookies.
FC BARCELONA informs users that it uses its own and third-party technical, personalisation, analysis (and advertising) cookies, which process connection and/or device data, as well as browsing habits for statistical and advertising purposes. Therefore, when accessing our website, in compliance with article 22 of the Law on Information Society Services, we have requested your consent to their use.

5. Responsibilities.
By making this OTT available to the USER, we wish to offer a quality service, using the maximum diligence in the provision of the same, as well as in the technological means used. However, BARÇA STUDIOS does not guarantee that the availability of the service will be continuous and uninterrupted, due to circumstances caused by problems in the Internet network, breakdowns in computer devices or other unforeseeable circumstances, so that the USER agrees to bear these circumstances within reasonable limits.
All matters relating to our OTT are governed exclusively by the applicable Catalan, Spanish and international legislation.
In the event of any conflict or discrepancy arising in the interpretation or application of these legal conditions, the courts or tribunals which, where applicable, will hear the matter, will be those which are provided for in the applicable legal regulations in terms of competent jurisdiction, which, in the case of end consumers, will be the place of fulfilment of the obligation or the place of the user's domicile.
In the event that the USER is domiciled outside an EU Member State, or that the transaction consists of a purchase and sale carried out by a company, both parties submit to the Courts and Tribunals of Barcelona (Spain), expressly waiving any other jurisdiction that may correspond to them.

6. Account of the USER.
The USER undertakes to use the Services and Content in a diligent, correct and lawful manner and, in particular, undertakes to refrain from the following: (a) using the Contents in a manner, for purposes or with effects contrary to the law, generally accepted morals and good customs or public order; (b) reproducing or copying, distributing, allowing public access by any means of public communication, transforming or modifying the Contents, unless authorised by the holder of the corresponding rights or it is legally permitted; (c) deleting, evading or manipulating the copyright and other identifying data.
The USER undertakes to use the Services and Content in accordance with the law, these Terms and Conditions of use and other notices, regulations of use and instructions of which he/she is aware, and also with generally accepted morals and good customs and public order.
The USER (in this case, the registered user) undertakes to make diligent use of the identification data that allows registration, subscription and access to the Services and/or Contents, and to keep them secret and safeguard them, in accordance with their personal and confidential nature. For all this, you will be liable if you do not comply with the obligations for the protection of your identifying data. In the same way, you will be responsible if the identifying data are misused by a third party and you have not duly notified BARÇA STUDIOS of this use once you have knowledge or suspect that it has occurred.
It is forbidden to make, without due authorization, any kind of advertising or commercial information directly or sending mass mailings (spamming) in a covert manner. The USER undertakes not to introduce programmes, viruses, macros, applets, ActiveX controls or any other logical device or sequence of characters that cause or are likely to cause any type of alteration in the computer systems of BARÇA STUDIOS or third parties.
The USER registered to the Barça Account agrees to provide, maintain and update true, accurate, current and complete information if requested to do so in the registration processes. You must not impersonate any other person or entity or misrepresent your identity or affiliation with any other person or entity, and you acknowledge and agree that we may take reasonable steps to verify the accuracy of the information you provide to us.
We may suspend or terminate your account and your ability to use the Services or any part thereof for impersonating another person or entity or otherwise misrepresenting your identity, for any breach of these Terms and Conditions or any special terms relating to a particular Service, for copyright infringement, or for any other reason.
The USER shall be solely liable for any claim or legal action, judicial or extrajudicial, brought by third parties against BARÇA STUDIOS and/or FC BARCELONA based on their use of the Services and/or the Content. If applicable, they must assume all expenses, costs and compensation caused to the CLUB or BARÇA STUDIOS as a result of these claims or legal actions.

7. Fraud.
The USER shall be liable to BARÇA STUDIOS and/or FC BARCELONA for any effective and proven damages, including damages of a reputational nature, arising from the breach of their obligations within the framework of these conditions or the breach of the applicable regulations, when this favours, results in, or in any other way contributes to the commission of fraudulent actions against BARÇA STUDIOS and/or FC BARCELONA and/or any third party.
Therefore, the USER shall refrain from any action (by action or omission) on their line or by other means that implies a use not contemplated in these conditions of the same and of the related services provided by BARÇA STUDIOS.
BARÇA STUDIOS may immediately suspend the service if it confirms any serious breach by the USER of this obligation.

8. Validity of the general conditions of access to OTT BARÇA ONE and modifications.
These General Terms and Conditions of Use have been modified on 21 March 2024. We may modify them at any time: please check the date of issue each time you connect to our OTT so that you can be sure that no modification affecting you has taken place.
The USER undertakes to inform FC BARCELONA or BARÇA STUDIOS, as appropriate, of any change in the personal details of this contract, especially those relating to the bank account for direct debit of payments, if any.
BARÇA STUDIOS will always inform the USER of any modification, indicating the precise reason for the modification, at least 15 days before the modification becomes effective, and the USER will have the right to terminate the contract without any penalty, without prejudice to other commitments acquired by the USER.
Once the period of one month has elapsed without BARÇA STUDIOS having received any communication when a modification of the conditions (and the price) takes place, it will be understood that the USER tacitly accepts them.

9. Online consumer dispute resolution through the European Commission's platform in accordance with Article 14 of Regulation (EU) 524/2013.
